Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you,” “your,” or “User”) and The Florida Association of Christian Colleges and Schools, Inc. (“FACCS,” “we,” “us,” or “our”) regarding your use of the FACCS Portal (the “Portal” or “App”). By accessing or using the Portal, you agree to be bound by these Terms.
Definitions
- "Portal" refers to the online platform provided by FACCS for member schools, parents, and authorized users.
- "User" refers to any individual or entity who accesses or uses the Portal.
Registration
You agree to provide accurate information regarding your email address and any additional required information when registering for the FACCS Portal. If your details change, you agree to promptly update your information and notify us at [email protected]. You acknowledge that registration is limited to:
- Authorized school representatives (e.g., administrators, teachers, coordinators)
- OR parents/guardians registering homeschool students for eligible programs
Age and Eligibility
The FACCS Portal is intended for use by adults who are authorized representatives of member schools or parents/guardians of homeschool students. The Portal is not intended for use by individuals under the age of 18. Although the Portal may contain or process information about students in grades 1-12 for purposes such as competition registration or accreditation, no student or minor should register for or use the Portal directly. If we become aware that a user does not meet the eligibility requirements or has registered without appropriate authorization, we reserve the right to suspend or terminate the account without notice.
Account Suspension or Termination
We reserve the right to suspend or terminate your access to the Portal at our sole discretion, with or without notice, if we believe you have violated these Terms, applicable laws, or used the Portal in a manner that may harm FACCS or its users.
Devices and Software
You are responsible for providing the necessary devices, software, internet connection, and browser or operating system updates to access and use the FACCS Portal. You agree that we may apply software updates or enhancements to the Portal from time to time, which may be required for continued use. We may also send you important service-related communications through the Portal, including notifications regarding deadlines, system status, or feature updates necessary for your participation in our programs.
Acceptable Use
You agree to use the FACCS Portal solely for lawful purposes in support of your role in a member school, homeschool context, or other authorized relationship with FACCS. You may only use the Portal in good faith and in compliance with all applicable laws and regulations. You may upload documents or files where permitted by the Portal, such as in connection with student competitions, school accreditation, or other FACCS-related programs. You represent that you have the necessary rights and permissions to upload such content, and that it does not contain:
- Personally identifiable student information without appropriate consent;
- Malware, viruses, or other harmful code;
- Content that is threatening, abusive, defamatory, discriminatory, obscene, or otherwise inappropriate in an academic or professional setting;
- Material that infringes on the intellectual property rights of others.
Privacy
We care about your privacy and the security of your data. By using the FACCS Portal, you agree to our Privacy Policy, which explains how we collect, use, and safeguard your information. You can review the full Privacy Policy at portal.faccs.org/privacy . The Portal is hosted in the United States. By continuing to use the Portal, you consent to the processing of your data in the United States, even if data protection laws in your jurisdiction differ. We do not knowingly collect personal information directly from children. All student-related data must be submitted by authorized school staff or, in the case of homeschool participants, by a parent or legal guardian. If we learn that a child's personal information has been submitted without appropriate authorization, we will take steps to delete it promptly.
Intellectual Property
All content on the FACCS Portal — including logos, page designs, visual components, and software code — is the property of FACCS or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, or use any part of the Portal for commercial purposes without prior written consent.
Limitation of liability
To the fullest extent permitted by law, FACCS and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from your use of the FACCS Portal. If we are found liable for any damages, our total liability will not exceed the greater of one hundred U.S. dollars ($100) or the amount you paid (if any) to use the Portal. Some jurisdictions do not allow certain types of limitations or exclusions, so these limitations may not apply to you. In such cases, our liability will be limited to the maximum extent permitted by law.
Indemnification
You agree to defend, indemnify, and hold harmless the FACCS Portal, including its staff, officers, affiliates, and service providers, from and against any claims, liabilities, losses, damages, and expenses (including reasonable legal fees) that arise from:
- your use of the FACCS Portal or related services;
- your violation of these Terms of Service; or
- any false or misleading information you provide.
We may require your cooperation in responding to or resolving any such claim.

We will work with you in good faith to resolve any issues in a timely and fair manner. Please refer to our Privacy Policy for details about how we collect, use, and safeguard your personal information.
Disclaimer: Warranty
The FACCS Portal is provided “as is” and “as available,” without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee that the Portal will be uninterrupted, error-free, secure, or free from viruses or other harmful components. Your use of the Portal is at your own risk.
Amendments
We may update or modify these Terms of Service from time to time. When we do, we will post the updated version on the Portal with a revised "Last Updated" date. By continuing to use the Portal after changes are posted, you agree to be bound by the revised Terms. We encourage you to review this page periodically to stay informed about any updates. If you do not agree to the updated Terms, you should discontinue use of the Portal and contact us to close your account.
Miscellaneous
These Terms of Service are the entire agreement between you and the FACCS Portal regarding your use of the Portal. They supersede all prior agreements, communications, and understandings. You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations without restriction. If any part of these Terms is found to be invalid or unenforceable, that part will be interpreted to reflect the original intent, and the remaining provisions will remain in full force and effect. Our failure to enforce any part of these Terms does not waive our right to enforce them later. These Terms are governed by the laws of the State of Florida, without regard to conflict of laws principles.
